Organization / Registration of a Will

The Required documents for petitions regarding the “Organization and/or registration of a Will” in the probate records of the Eccl. Court

 

1) Printed application of the applicant (petitioner) includes all the information about the Clause of Will, followed by contact information and address of the applicant (petitioner) in case of the need of any clarifications about any information.

 

2) The Will must be printed out and submitted as a hard copy, the provisions of the Will must be clearly pointed out and free of ambiguity where all the property to be devised must be specified clearly as following: a) the property to be devised must be specified clearly, b) the name of the legatees must be specified in particular and by their full names, c) the shares of each of the legatees must be clearly specified and pointed out without any ambiguity.

 

3) The devisor / testator must attend and / or be present in person before the Court in order to submit his Will, along with at least three Witnesses. The aforementioned witnesses must be of the Roman Orthodox parish.

 

4) A certificate issued by the parish priest, stating the religious affiliation of the devisor/testator, and that he/she is a member of the Roman Orthodox parish.

 

5) A certificate issued by the parish priest, stating that the prior mentioned witnesses are members of the Roman Orthodox parish.

 

6) A valid Image replica (photocopy) of the ID and/or passport of the petitioner (devisor), the witnesses, and of the legatees if possible.

 

7) Certificates of registry (bond certificate) duly by assets and law certified, of the estates, movable and immovable property to be devised, along with bank statements and/or balance sheets, all must be submitted to the Court. Due to the assests and law, the ratification of the prior mentioned certificates should not exceed three months to the date it was issued when submitted.

 

8) Payment of the requested fees according to the fees list issued by the Court.

 

***NOTE: all the above mentioned documents should be submitted to the Court. Any petition that does not meet the requirements/conditions will be rejected, as the Court may request other documents if and when deemed necessary.
